These general conditions bind all persons who use the site and/or register at the internet address www.hotelkamynite.com. When using the website www.hotelkamynite.com, persons undertake to comply with these General Terms and Conditions, as well as the legislation of the Republic of Bulgaria and the European Union applicable to the goods and services provided on the Site. By clicking on any object, link or button located on the pages of the Internet address www.hotelkamynite.com, the persons who use the site agree and fully accept and undertake to comply with these General Terms and Conditions.

This means that we will protect the personal information of all visitors who access our website or services through any mobile application, platform or device, as well as visitors to our restaurants and venues.

What types of personal data does MAVIYANA EOOD collect, process and store?

1. "MAVIYANA" EOOD carries out the following operations with personal data for the following purposes:

Registration of a user on the website and execution of a contract for hotel accommodation - the purpose of this operation is to create a profile that will be used to track and document your orders. Conclusion of the impact assessment: Based on the above impact assessment, the personal data protection officer considers that the operation "Contracting a contract for home delivery of food" is permissible to carry out and provides sufficient guarantees to protect the rights and legal interests of data subjects in accordance with GDPR requirements.
Conclusion and execution of a commercial transaction with a customer or partner - the purpose of this operation is the conclusion and execution of a contract with a commercial partner or customer and its administration;
Sending informational messages - the purpose of this activity is to administer the process of sending messages to customers that refer to improvements or changes in the services, according to the contract for the provision of the service.
Sending a newsletter - the purpose of this operation is to administer the process of sending newsletters to customers who have indicated that they wish to receive them;
"MAVIYANA" EOOD processes the following categories of personal data and information for the following purposes and on the following grounds:
Data: Your individualizing data (name and surname, e-mail, address, telephone)
Purpose for which the data is collected: 1) User registration; 2) Providing a hotel accommodation service; 3) Making contact with the user and sending information to him, including if he wishes - to send newsletters and advertising messages;
Basis for processing your personal data - By registering on the website and purchasing a service, a contractual relationship is created between "MAVIYANA" EOOD and you, on the basis of which we process your personal data - art. 6, para. 1, b. (b) GDPR.
Other data that "MAVIYANA" EOOD processes - When entering our website or your profile, "MAVIYANA" EOOD collects data about the IP address used.
Purpose for which the data is collected: Improving the security of the service and localization of the interface, statistical and marketing research.
Grounds for data processing: Processing is necessary for the performance of a contract to which the data subject is a party - art. 6, paragraph 1, b. (b) of the GDPR. Until the user's profile is created, the IP address is collected on the basis of fulfilling the administrator's legitimate interests - art. 6, paragraph 1, b. (f) by the GDPR;
Your data for issuing an invoice to an individual - If you wish to be issued an invoice as an individual, you should provide your unique civil number.
Purpose for which the data is collected: Issuing an invoice for making payments under a contract for the provision of services.
Basis for processing your personal data - By registering on the website, or upon concluding a written contract, a contractual relationship is created between "MAVIYANA" EOOD and you, on the basis of which we process your personal data - art. 6, paragraph 1, b. (b) GDPR.
Your data for making direct payments through the interface of our website - If you wish to make a direct payment through our website, you must enter personal data related to your bank account and bank card, namely: you must enter your bank card number, date of card validity, unique code and card issuer and card "type"
o Purpose for which the data is collected: Making payments under a contract for the provision of services.

o Basis for processing your personal data - With registration on the website or when concluding a written contract, a contractual relationship is created between "MAVIYANA" EOOD and you, on the basis of which we process your personal data - art. 6, paragraph 1, b. (b) GDPR.

"MAVIYANA" EOOD does not collect or process personal data that refer to the following:
reveal racial or ethnic origin;
reveal political, religious or philosophical beliefs, or membership in trade unions;
genetic and biometric data, health data or data about sex life or sexual orientation.
The personal data were collected by "MAVIYANA" EOOD from the persons to whom they refer.
The Company does not perform automated data decision making.
The company does not process data for persons under the age of 16, except with the express consent of their parents or representatives.
Period of storage of your personal data

1. "MAVIYANA" EOOD stores your personal data for a period not longer than the existence of your profile on the website. After the expiry of this period, "MAVIYANA" EOOD takes the necessary care to delete and destroy all your data, without unnecessary delay.

2. "MAVIYANA" EOOD notifies you in the event that the data storage period needs to be extended in order to fulfill the objectives, fulfill the contract, in view of legitimate interests of "MAVIYANA" EOOD or otherwise.

3. "MAVIYANA" EOOD stores your data, given on the basis of consent, until its explicit withdrawal, and this does not affect publications and comments made in order to preserve the meaningful integrity of the comments.

4. "MAVIYANA" EOOD stores the personal data, which it is necessary to keep under the applicable legislation, for the relevant stipulated period, which may exceed the period of existence of your registration.

Transmission of your personal data for processing

1. "MAVIYANA" EOOD may, at its own discretion, transfer part or all of your personal data to personal data processors for the fulfillment of the processing purposes in compliance with the requirements of Regulation (EU) 2016/679.

2. "MAVIYANA" EOOD notifies you in case of intention to transfer part or all of your personal data to third countries or international organizations.

Withdrawal of consent to the processing of your personal data

1. If you do not want all or part of your personal data to continue to be processed by "MAVIYANA" EOOD for specific or all processing purposes, you can withdraw your consent to processing at any time by filling in the form published on our website or by free text request.

2. "MAVIYANA" EOOD may ask you to verify your identity and identity with the person to whom the data refers.

3. With the withdrawal of consent to the processing of personal data, which is mandatory for the creation and maintenance of your registration for using the services, your account will become inactive.

Right to erasure ("to be forgotten")

1. You have the right to request from "MAVIYANA" EOOD the deletion of your personal data, and "MAVIYANA" EOOD has the obligation to delete them without undue delay, when any of the following grounds are present:

the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
You withdraw your consent on which the data processing is based and there is no other legal basis for the processing;
You object to the processing of your personal data, including for direct marketing purposes, and there are no overriding legal grounds for the processing;
the personal data were processed unlawfully;
personal data must be deleted in order to comply with a legal obligation under EU law or the law of a member state that applies to "MAVIYANA" EOOD;
personal data were collected in connection with the provision of information society services.
"MAVIYANA" EOOD is not obliged to delete personal data if it stores and processes them:
to exercise the right to freedom of expression and the right to information;
to comply with a legal obligation that requires processing provided for in EU or Member State law applicable to the Administrator or for the performance of a task in the public interest or in the exercise of official powers conferred on him;
for reasons of public interest in the field of public health;
for the purposes of archiving in the public interest, for scientific or historical research or for statistical purposes;
for the establishment, exercise or defense of legal claims.
In order to exercise your right to be "forgotten", you should submit a written request sent to "MAVIYANA" EOOD, as well as certify your identity and identity with the person to whom the data relates to "MAVIYANA" EOOD, by presenting on the spot your identity card for identification purposes to an employee of "MAVIYANA" EOOD.
"MAVIYANA" EOOD does not delete the data that it has a legal obligation to store, including for defense in connection with legal claims made against it or proving its rights.
Right to limitation

Art. 10. You have the right to claim from "MAVIYANA" EOOD to limit the processing of your data when:

dispute the accuracy of the personal data, for a period that allows "MAVIYANA" EOOD to verify the accuracy of the personal data;
the processing is illegal, but you do not want your personal data to be deleted, but only to have its use restricted;
"MAVIYANA" EOOD no longer needs the personal data for the purposes of processing, but you require them to establish, exercise or defend your legal claims;
You have objected to the processing pending verification of whether the legal grounds of "MAVIYANA" EOOD take precedence over your interests.
Right of portability

You can at any time download the data that is stored and processed for you in connection with the use of the services of "MAVIYANA" EOOD with a request by e-mail.
You can request "MAVIYANA" EOOD to directly transfer your personal data to an administrator specified by you, when this is technically feasible.
Right to receive information

You can ask MAVIYANA EOOD to inform you about all recipients to whom the personal data for which correction, deletion or restriction of processing has been requested has been disclosed. 1. If "MAVIYANA" EOOD detects a breach of the security of your personal data, which may create a high risk for your rights and freedoms, we notify you without undue delay of the breach, as well as of the measures that have been taken or are about to be taken .

2. "MAVIYANA" EOOD is not obliged to notify you if:

has taken appropriate technical and organizational measures to protect the data affected by the security breach;
has subsequently taken measures to ensure that the breach will not result in a high risk to your rights;
notification would require a disproportionate effort.
Persons to whom your personal data is provided

1. For delivery to your home and after your request, "MAVIYANA" EOOD transmits the necessary information to its respective employee-administrator, who performs the "hotel accommodation" service and who processes your data as an administrator for the purposes of hotel accommodation.

2. The administrator does not transfer your data to third countries.

What does processing personal data mean?

The processing of personal data includes the collection, storage, destruction, transmission, correction, updating, deletion, destruction and all other actions that are performed with your personal data.

Do you have an obligation to provide us with your personal data?

In order to be able to provide our products and services, we collect and process your personal data. We also process them in order to fulfill legal obligations.
In the event of your refusal to voluntarily provide the required personal data, "MAVIYANA" EOOD will not be able to provide its products and services, for example, you will not be able to benefit from hotel accommodation.

Changes to Privacy Policies.

In the future, we may need to update this Privacy Policy from time to time in response to changing legal, technical or business processes.
We encourage you to periodically review this page for the latest information on our privacy practices.
In the event that, as a result of changes made to these Privacy Policies, new purposes for processing personal data or other circumstances requiring your express consent are foreseen, we declare that we will also notify you by sending a letter by electronic means (e-mail) to the e-mail provided by you, with which we kindly invite you to confirm or decline to provide consent.
This will give you the opportunity to stop using some or all of the services and/or to exercise your rights, some of which are expressly stated above.
These Privacy Policies have been adopted by "MAVIYANA" EOOD and are in effect from 01.25.2021.

Registering a user profile?

The site can be viewed by visitors freely without registration.
Registration is performed by the User before payment for an online order. The fields that must be filled in. The user agrees and declares that he will provide true, accurate, up-to-date and complete information when filling out the registration form. Upon registration, the User agrees to voluntarily provide the personal data required by the registration form. STONES may at any time change the amount of personal data required for registration on the Site.
In the event that the User provides false, inaccurate, out-of-date or incomplete information, KAMANITE has the right to close and/or delete the relevant information and refuse further access to part or all of its services, or to completely delete the registration and terminate this contract without prior notice. STONES is not responsible for incorrect and/or inaccurate execution. An order made in connection with the information received by the User. STONES is not responsible for undelivered orders or other non-fulfilments due to outdated data and resending of Goods is the responsibility of the User.
When registering on the Site, the User specifies an e-mail and password to access the User Profile. The user bears full responsibility for the protection of his e-mail and password, as well as for the actions of third parties with the same. The User should end each session in the User Profile by exiting it, for security and data protection purposes. In case of suspicion of illegal or unauthorized access, stolen or lost e-mail and/or password, the User should notify the STONES immediately, in order to suspend access to the User's personal information and avoid unauthorized actions with the User Profile.
By registering and creating a User Profile, the User gives his express consent to the personal data he entered during registration and accordingly changed/supplemented subsequently, to be used and stored by KAMANITE for the purposes specified in the General Terms and Conditions.
A User profile can be closed at any time at the User's request.
An order

The execution of Orders and the conclusion of purchase and sale contract(s) with the STONES can also be done without registering a User Profile. By making a reservation without registration, the User gives his express consent for the personal data he entered during the Order to be used and stored by the STONES for the purposes specified in the General Terms and Conditions. The fields that must be filled in to place the Order are marked. The User agrees and declares that he will provide true, accurate, up-to-date and complete information when filling in the data to place an Order without registration. The user agrees to voluntarily provide the personal data required by the form for making a reservation without registration. STONES may at any time change the amount of personal data required to place an Order without registration. In the event that the User provides false, inaccurate, out-of-date or incomplete information when making a reservation without registration, the Provider has the right to refuse further access to part or all of its services. The Provider is not responsible for a false and/or inaccurately executed reservation made in connection with the information received by the User when making a reservation without registration. The provider is not responsible for non-provision of services or other defaults due to out-of-date data.
The User has the right to request all services specified on the Site. When making a reservation, the User has the right to choose the type of services, their quantity and duration, the method of payment, according to the options offered on the Site.
For each service on the site, information is provided regarding the price of the service, the main characteristics of the service and additional information aimed at helping Users make an informed choice when booking. The provider is not responsible for inaccuracies in the description of the service, which do not relate to the main characteristics of the service, and does not claim the completeness of the information provided.
All prices indicated on the website are in Bulgarian leva and include value added tax and local tourist tax. The Provider has the right to change the prices indicated on the Site, at its discretion, at any time and without being obliged to notify the Users in advance. The user is obliged to pay the price that was indicated on the site at the time of making the reservation, regardless of whether it is lower or higher than the updated price.
Each selected service is requested by e-mail. Until the reservation is confirmed, the User can review and change the reserved services, quantities, payment method and other data related to the specific reservation.
The reservation is made by following the following basic technical steps:
- Overview of the offered services;
- Request for the service/e through the reservation form;
Upon finalization of the reservation and its confirmation by the User, the latter undertakes to pay the price of the Order and again declares that he is aware of the fact that the Order is associated with an obligation to pay on his part. After completing the order, you will receive a call from us confirming the same information on the specified phone.
Users understand and agree that certain goods may not be available at the time the Order is placed. In the event that the Supplier is unable to fulfill the Order, due to the fact that it does not have available goods, the Supplier shall notify the User of its depletion on the contact telephone number specified by the User or by sending a message to the e-mail address specified by the User electronic mail.
Problems with order fulfillment

Although we strive to perform all services accurately, the performance of your request may be prevented for any of the following reasons:

We do our best to update stock in a timely manner, but it is possible that some of the premises are occupied, in which case we will contact you as soon as possible.
You have provided incorrect or incomplete booking details - names, address, telephone, postal code.
In the event of a discrepancy between the received and provided services or an inaccuracy due to our fault, we will compensate you in a manner specified by you.
If the deposit is not transferred within 3 working days, the reservation is considered cancelled.

Payment

• Cash payment.
  Payment is made on the spot at the family hotel "Kamynite".
  All prices are in BGN with VAT included.
• Payment by bank card through VPOS (you may note that the service is yet to be activated).
• Payment by bank card through MyPos. Payment is made after providing the relevant credit card data, which is billed remotely with the express consent of the cardholder.
• Payment by bank transfer to the following bank account /in BGN/: Beneficiary: Maviyana EOOD Bank: KBC Bank Bulgaria EAD, Burgas branch BIC: RZBBBGSF IBAN: BG48RZBB91551013359760

 

Order cancellation and return

The user can cancel the reservation made by him under the following conditions:

• Up to 21 days before the check-in date - the entire deposit is refunded.

• Between 7 and 21 days before the check-in date - 50% of the deposit is refunded.

• Less than 7 days before the check-in date, the deposit is non-refundable.

In case the payment was made with a bank card, the refund is made by ordering a reverse operation on the card with which the payment was made.

All sums subject to return, according to the above conditions, are subject to return within a period of 14 days.
